2006 Stallion Service Auction
Terms & Conditions
A. The highest bidder is to be the buyer. If any dispute arises between or among two or more bidders, sole authority to settle this dispute as he sees fit is reserved by the auctioneer, and his decision shall be final. The auctioneer reserves the right to reject any or all bids.
B. All stallion services must be paid for in full during or immediately after the sale by the highest bidder. Either cash or check will be accepted with proper identification. PayPal will be used for all on-line bidding.
C. Anyone may bid on a stallion including the stallion owner. The minimum bid at the live auction will be $200 for stallions with a stud fee of less than $400. For stallions whose regular stud fee is more than $400, the minimum bid is ½ the regular advertised fee. All buyers of stallions sold will be assessed a $50 office charge. All stallion services that do not sell during the live auction will remain on the web site where they may be purchased for ½ the advertised fee up to June 1, 2006.
D. Stallion owners whose donated service sells will be eligible to enter one foal by his stallion in the Stallion Breeders Futurities. In the case of a stallion’s service not selling by June 15, 2006, the stallion owner may buy back his own stallion’s service within 30 days of June 15, 2006 for a minimum bid of $250. This will enable the stallion owner to enter one foal in the Stallion Breeders Futurities. If the stallion owner purchases his breeding for ½ the advertised fee, the stallion owner may enter two foals in the Stallion Breeders Futurities. No bids will be accepted after July 15, 2006.
E. An acknowledgement of Stallion Service purchase will be handed to each buyer for signature. Please write clearly giving full name, address and phone number. A BIDDER NUMBER WILL BE REQUIRED FOR BUYER.
F. Upon receiving payment the cashier will mark the duplicate contract sheet “paid” as acknowledgement of receipt of funds. The buyer receives a copy as does the stallion owner. The Colorado West Paint Horse Club (“CWPHC”) secretary will keep a copy on file.
G. Stallion services not sold through the live auction will be available for sale through June 1, 2006. These stallions may be purchased by mail-in bid (must be postmarked by May 15, 2006) or on-line at the CWPHC web site through June 1, 2006. Bidding regulations on-line may be viewed on the web site. Successful bidders will be notified by June 15, 2006.
H. All efforts have been made to ensure correctness of the stallion information. The sale management and auctioneer are not responsible for errors or omissions and assume no liability on its part, or the part of the seller as to same. Announcements made sale day supersede printed material.
I. Any person attending this auction does so at his/her own risk, and no liabilities, duties, obligation and/or responsibilities shall be imposed upon CWPHC nor any of its officers; sale location; or any other persons putting the sale together; for any accident, injury, mishap, theft, damage, and/or any other harm regardless of the source; according to Colorado Law, that an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-119, Colorado Revised Statutes.
J. All breeding dates are to be made solely between the buyer and the stallion owner.
K. Stallion services must be used in the same year that the service is bought. All guarantees are between the stallion owner (or breeding contract) and the service purchaser. No refunds will be made by CWPHC.
L. The stallion owner has the right to reject the mare that is brought to his stallion, due to health, manners of the mare, or any other reason deemed necessary to the stallion owner.
M. All mares using the services of a stallion bought through this auction must be registered Paint, Quarter or Thoroughbred. Breeding stock papers will also be accepted, or otherwise stated when horse sells. Quarter Horse stallion owners must specify if only Paint mares will be accepted for this breeding.
N. Anyone buying a stallion service for someone else as a GIFT must so state in the ‘mare owner-buyer’ portion of the sales contract. Mare owner who will be using the stallion service must be designated by name.
O. Mare owners who purchase a stallion service or receive a gift purchase through this auction and are the recorded APHA owner or registered lessee on file with APHA under rule RG-045-A, will be eligible to enter the resulting Paint or Breeding Stock foal in the CWPHC SSA Breeders Futurities.
P. If for some reason the mare does not deliver a live foal the first year and you have return of services privileges, you have one more year to produce a live foal for the Stallion Breeders Futurities.
Q. 50% of the net proceeds of the Halter Stallion Service Auction will go to Colorado West Paint Horse Club for operating funds. The remaining 50% will go to the Stallion Service Auction Breeders Futurities with the following split: 40% will be earmarked for the Stallion Breeders Weanling Futurity; 10% will be set aside for the Stallion Breeders Extended Futurities to be paid out in their designated years.
R. 50% of the net proceeds of the Reining Stallion Service Auction will go to Colorado West Paint Horse Club for operating funds. The remaining 50% will go to the Stallion Service Auction Breeders Futurities with the following split: 40% will be earmarked for the Stallion Breeders 3-year-old Reining Slide Futurities; 10% will be set aside for the Stallion Breeders Extended Futurities to be paid out in their designated years.
S. Once a service contract is signed to donate a stallion’s service to CWPHC Stallion Service Auction, that stallion service becomes the property of CWPHC. Any grievances concerning the Stallion Service Auction must be in writing to the Stallion Service Auction Committee who in turn will present it to the Executive Board for decision and requires a $100 fee, which may or may not be returned, dependant upon the decision of the Board.
